Welcome to Kwantor! This website and associated services, including the webapp and mobile apps (collectively referred to as the "Service") are provided by Wouter Roozen, trading under the name ‘Kwantor’ (collectively referred to as "Kwantor," "we," "us," or "our"), registered with the Dutch Chamber of Commerce under number 88884376, and with VAT number NL004669591B71.
Terms of Use
These Terms and Conditions (the "Terms") govern your use of the Service, and by accessing or using the Service, you agree to be bound by these Terms. Please read these Terms carefully before using the Service. These Terms apply to all visitors, users, and others who wish to access or use the Service. If you disagree with any part of the Terms, then you do not have permission to access the Service.
Description of the Service
Kwantor provides software that allows its target users to create a project and collaborate with other parties specified by the target user. The Service is provided "as is," and we do not guarantee the accuracy, legality, suitability, or applicability of the materials provided by the Service. You are solely responsible for determining the legal status and applicability of any agreements or any other arrangements you create through the Service, including the legal validity and applicability of the signatures.
Kwantor does not provide legal advice and using Kwantor does not create an attorney-client relationship. If you need legal advice, you should consult with a licensed attorney in your jurisdiction. You agree to comply with all applicable laws, rules, and regulations in connection with your use of Kwantor.
Beta Status
Kwantor is currently in beta. We do not guarantee the availability or continuity of the Service, and we may modify or discontinue the Service at any time without notice. By using the Service, you acknowledge and agree that Kwantor will not be liable for any loss or damage arising from your use of or inability to use our software during the beta period.
Fees and Payments
The current beta version of Kwantor is free of charge.
Term and Termination
We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
Intellectual Property
The Service and all content and materials contained therein, including but not limited to software, text, graphics, logos, images, and other materials, are owned by or licensed to Kwantor and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You may not use the Service for any other purpose or reproduce, modify, distribute, or otherwise create derivative works of any content or materials from the Service without our prior written consent.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THE ACCURACY, LEGALITY, SUITABILITY, OR APPLICABILITY OF THE MATERIALS PROVIDED BY THE SERVICE, AND WE EXPRESSLY DISCLAIM ANY LIABILITY FOR ANY ERRORS OR OMISSIONS IN SUCH MATERIALS.
Limitation of Liability
In no event shall Kwantor, its partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including, but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory.
Indemnification
You agree to indemnify and hold Kwantor and its agents harmless from any and all claims, liabilities, damages, and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of Kwantor.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without giving effect to any principles of conflicts of law. Any legal action or proceeding arising out of or related to these Terms or the Service shall be brought exclusively in the courts of the Netherlands.
General
These Terms constitute the entire agreement between you and Kwantor with respect to the Service and supersede all prior or contemporaneous communications and proposals. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
